SaskTenders e-Service ("Service") is offered to you by the Government of Saskatchewan ("Government") as a method of notification for competitions published on the SaskTenders website by ministries of the Government and other public sector entities
If you register, the Service will send you notifications, via Email, of competitions in the commodity groups that you have selected.
By registering to receive information through this Service, you understand and agree that:
1. You are responsible for ensuring that your registration and account information is complete, accurate and up to date.
2. Any personal information you supply to register as a user of the Service is collected by the Government under the authority of the Freedom of Information and Protection of Privacy Act of Saskatchewan and is necessary for the operation of the Service. By registering as a user of the Service, you consent to the collection of this information and the use and disclosure of the information as may be required for the effective operation of the Service. Personal information collected will be used to identify users and track their activities within the Service. Personal information supplied in a submission or activity and identifying information from a SaskTenders user ID (automatically attached to each activity) will be disclosed to the ministry of the government or public sector entity that posted the opportunity, and will be used for management of the activity within that ministry or entity. Personal information held by the ministry officials who operate the Service may also be used to contact Service users for the purpose of correcting Email routing, other system-related errors or supplier development activities. 3. The Government may post your information online as it relates to your interest in specific competitions or competition updates posted on SaskTenders. The Government and any public sector entity which posted a competition on SaskTenders may also post your organization’s name, address and/or location upon award of the competition. The total bid price may also be posted for certain competitions upon award.
4. The Service should not be relied on as the exclusive method of notification of competitions or competition updates offered by the Government and public sector entities. For example, there may be technical issues that affect the provision of the Service, or variance as to how the the Government and public sector entities choose the commodity groups or locations to which they post competitions. You are solely responsible to check the SaskTenders website, or the website used by the posting entity, for any updates or changes to the posted competition.
5. In the event that SaskTenders receives an electronic transmission from you that is or is suspected to be infected with a virus or other electronic code, that, in the sole opinion of the Government is considered harmful, the Government reserves the right to take actions as it deems necessary to disinfect or quarantine such electronic transmission. The Government is not responsible for any changes that may occur to the electronic transmission submitted by you, including rendering such transmission unreadable or ineligible for the competition or for any delays or non delivery of submissions as a result of the disinfecting or quarantine processes.
6. You acknowledge that any material posted on the SaskTenders website is the property of the Government or the public entity which posted the material. You will not use, copy or distribute it, other than as required to prepare your competition response, without the express authorization of the party that posted the material. The Government is not an agent or representative of a public entity which posts material on SaskTenders and has no responsibility to you for the content of such posting or the conduct of such competition .
7. The Service is provided free of charge to users and, as such, is provided "as is" without warranty of any kind, express or implied, including warranty of fitness for a particular purpose. The Government of Saskatchewan does not represent or warrant: (A) the accuracy or the completeness of the Service, or that the Service will function without error, failure or interruption; (B) the accuracy, completeness or currency of the materials posted on the SaskTenders website (C) that the Service is free of viruses or other harmful components
8. No action may be brought by any person against the Government for any loss or damage of any kind which may result from, arise out of, or in any way be related to your use of or registration to use the Service, including, without limitation, reliance on the functioning of the Service. In no event shall the Government be liable for any damages of any nature or kind, including damages arising from actions based on negligence, contract, or any other cause of action, which arise out of, result from, or in any way relate to the use of or inability to use the Service.
9. You agree to indemnify and hold the Government harmless from any claim, proceeding, action, or liability of every nature and kind which may arise and which results from, relates to or arises out of your use of the Service and which is in contravention of these Terms and Conditions or any rules of use for the Service specified by the Government from time to time.
10. The Government may discontinue the Service or suspend your use of the Service at any time and for any reason, without any given notice.
11. The Government may amend these Terms and Conditions at any time by providing notice to you of the amended Terms and Conditions at the most current contact information which you have provided as a user. Continued use of the Service after such notice has been sent to you constitutes your acceptance of the amended Terms and Conditions.
12. The Service is provided only for the purposes described on the SaskTenders website and cannot be used for any other purpose.
13. Links from or to the SaskTenders website are provided for convenience only. The Government does not review, endorse, approve or control, and is not responsible for any sites linked from or to the Service, the content of those sites, the third parties named therein, or their products or Services. Users use the links to these sites at their sole risk.
14. The laws of Saskatchewan shall govern this Agreement and the courts of Saskatchewan shall have exclusive jurisdiction over any dispute arising hereunder.
